Used Chamber Marketplace Terms
These terms govern the Used Chamber Marketplace only. They override the general site Terms & Conditions where the two conflict. By posting a listing, browsing listings, or contacting a seller through this marketplace, you agree to everything below.
1. What This Marketplace Is
The Prestige Hyperbaric Used Chamber Marketplace is a listing service. Prestige provides the platform. Buyers and sellers transact directly with each other.
Prestige is not a party to any sale between a buyer and a seller. Prestige does not act as a broker, agent, dealer, reseller, escrow holder, appraiser, inspector, or fiduciary in a marketplace transaction, and no such relationship is created by any use of the marketplace.
2. Listing Fee — $300, Non-Refundable
Sellers pay a flat $300 fee per listing. There is no fixed expiration date on a listing — listings run on a rolling basis while the seller keeps them current (see §2a) — but the fee is a one-time posting fee, not a subscription. The fee is:
- Non-refundable once the listing is published, regardless of whether the unit sells, sells for less than the asking price, is withdrawn by the seller, or is unpublished for a missed refresh (see §2a);
- Not tied to any sale outcome. Prestige has no way to verify whether a sale ultimately occurs, at what price, or through what channel;
- Refunded only when Prestige rejects a submitted listing before publication (see §5).
Promotional discount codes may reduce the listing fee at checkout. Codes are non-transferable and may be revoked at any time.
2a. Required 30-Day Refresh
Chambers rarely sell in a fixed window, so listings do not expire on a schedule. In exchange, the seller must actively confirm the listing is still current on a rolling 30-day cadence:
- Every 30 days from the last confirmation, the seller receives a refresh reminder at the email on file;
- The seller must click the refresh link to affirm that (i) the chamber is still available, (ii) they still want to sell it, and (iii) the price, condition, and contact info in the listing are still accurate;
- If the seller does not refresh within 7 days of the reminder, the listing is automatically unpublished. It can be reactivated at any time by logging in and clicking Refresh — no new fee is charged for the same listing;
- Prestige may retire a listing entirely (no reactivation) after prolonged inactivity, for repeated stale contact info, or for any §5 reason. Retirement does not trigger a refund.
The purpose of the refresh is to keep buyers from wasting time on chambers that are already sold, no longer for sale, or listed with outdated pricing. Refreshing is free and takes one click.
3. What Sellers Warrant
By posting a listing, the seller represents and warrants that:
- They are the lawful owner of the unit or are authorized to sell it on the owner's behalf;
- The unit is free of undisclosed liens and encumbrances;
- All statements in the listing — model, year, hours, condition, included accessories, location — are true and complete to the seller's knowledge;
- The seller will respond to buyer inquiries in good faith and will not use the marketplace to solicit business unrelated to the sale of the listed chamber;
- The seller's contact information provided in the listing is current and belongs to the seller;
- The seller will complete the required 30-day refresh (see §2a) or accept that the listing will be unpublished until they do.
Prestige does not independently verify any of the above and disclaims responsibility for any misrepresentation by a seller.
4. What Buyers Acknowledge
By viewing seller contact information or contacting a seller, the buyer acknowledges and agrees that:
- All units are sold AS-IS, WHERE-IS, WITH ALL FAULTS by the seller;
- Prestige has not inspected, tested, appraised, verified, or endorsed the unit;
- The buyer is solely responsible for inspecting the unit in person, verifying the hour meter reading, confirming included accessories, and evaluating condition prior to purchase;
- No warranty of any kind — express or implied, including any warranty of merchantability or fitness for a particular purpose — is offered by Prestige on a marketplace unit;
- Any purchase decision is made based on the buyer's own due diligence, not on Prestige's involvement in hosting the listing.
5. Prestige's Review Right
Prestige reviews every submitted listing before publication. Prestige may reject, edit for clarity, or unpublish any listing at its sole discretion, including but not limited to listings that:
- Are not for a hyperbaric chamber (accessories, add-ons, and unrelated equipment are not permitted);
- Appear fraudulent, misleading, or intended to defraud a buyer;
- Contain content that violates any law or third-party right;
- Contain hostile, defamatory, or harassing language;
- Attempt to solicit unrelated business or promote a competing marketplace.
When Prestige rejects a listing before publication, the $300 fee is refunded in full. Once a listing is published, no refund is issued, even if the listing is later removed for cause.
6. Prestige Does Not Answer Questions About Listings
Prestige does not accept phone, email, or text inquiries about specific marketplace listings. Contact the seller directly through their listing.
Questions like "should I buy this one," "is this a fair price," "will you inspect it before I pay," "can you help me negotiate," and any request for pre-purchase guidance are outside the scope of the marketplace service. Prestige will not answer these questions at any price. The only doorway into Prestige involvement is the 20% Deal Facilitation Fee described in §7.
7. The 20% Deal Facilitation Fee
If a buyer and seller have independently agreed on a sale price and want Prestige to formally facilitate the transaction, Prestige may — at its sole discretion — accept the engagement in exchange for a fee equal to 20% of the final agreed sale price, paid upfront by the buyer at the time of purchase.
The 20% fee covers Prestige's coordination end-to-end for that transaction and may include: pre-purchase inspection, coordinated pickup or shipping, white-glove reinstallation at the buyer's location, payment routing, and reasonable dispute mediation between buyer and seller. The specific scope for each engagement is confirmed in writing before Prestige takes any action.
Terms of the 20% Facilitation engagement:
- The fee is paid in full up front. Prestige takes no action until the fee is received in cleared funds;
- Buyer and seller must both consent in writing to Prestige's involvement;
- Facilitation does not convert Prestige into a party to the underlying sale. The sale remains between buyer and seller. Prestige is a paid coordinator, not a warranty provider, dealer, or escrow institution;
- Prestige provides no warranty on the unit and does not indemnify either party against transaction-related losses;
- Individual services (e.g., moving only, inspection only) are not offered separately in the marketplace context — the 20% covers the full engagement or nothing.
To request facilitation after a price has been agreed, use the Facilitation Request form.
8. No Warranty; No Liability
To the fullest extent permitted by law, Prestige disclaims all liability arising out of any marketplace transaction, including but not limited to: misrepresentation by a buyer or seller; latent defects in a unit; unit failure after sale; personal injury or property damage arising from operation of a unit sold via the marketplace; failed delivery, damage in transit, or logistics disputes; and disputes over payment, condition, or included accessories.
Buyer and seller each release Prestige, its owners, employees, and affiliates from any and all claims arising out of or related to any marketplace listing or transaction. This release does not apply to the specific written scope of a 20% Facilitation engagement, where Prestige's liability is limited to the amount of the facilitation fee actually paid.
9. Contact Information Use
Seller contact information posted on a listing is displayed to logged-in buyers for the purpose of completing a marketplace transaction. It is not for bulk contact, resale, spam, or solicitation of unrelated business. Prestige may take listings down and ban accounts that violate this rule.
10. Prohibited Conduct
- Listing anything other than a hyperbaric chamber (parts, accessories, add-ons, or unrelated equipment);
- Listing a unit the seller does not own or is not authorized to sell;
- Misrepresenting a unit's model, year, hours, or condition;
- Using the marketplace to funnel buyers to an off-platform channel to avoid the listing fee;
- Attempting to engage Prestige services without paying the 20% Facilitation Fee;
- Any use that violates the site-wide Terms & Conditions, Privacy Policy, or applicable law.
11. Governing Law
These terms are governed by the laws of the State of Florida. Any dispute involving Prestige's operation of the marketplace shall be brought exclusively in the state or federal courts located in Pasco County, Florida.
12. Changes
Prestige may update these marketplace terms at any time. Updates take effect when posted, and the "Last updated" date at the bottom of this page will reflect the change. Continued use of the marketplace after an update constitutes acceptance of the new terms.
Questions about these terms — not questions about a specific listing — may be sent to prestigehyperbaric@gmail.com with subject line "Marketplace Terms Question."
